DELIVERY AND TRANSFER OF GOODS TO THE BUYER
5.1. The methods, procedure, and delivery times for goods are specified on the website under the "DELIVERY AND PAYMENT" section. The Buyer agrees on the delivery procedure and conditions with the online marketplace operator at the time of purchase.
5.2. Self-pickup of goods:
5.2.1. After placing an order, the Buyer can make payment and collect the purchased goods at the "Nova Poshta" branch.
5.2.2. The ownership and the risk of accidental loss or damage to the goods transfer to the Customer or their Representative upon receiving the goods and signing the product receipt and/or delivery order (and/or instructions for purchase and delivery).
5.3. The delivery of goods is carried out by the employees of the online marketplace using their own resources according to the delivery terms or with the involvement of third parties (carrier).
5.4. Upon receiving the goods, the Buyer must, in the presence of the courier's representative, verify the compliance of the goods with their qualitative and quantitative characteristics (product name, quantity, completeness, expiry date).
5.5. The Buyer or the Buyer's Representative, upon receiving the goods, confirms by their signature on the receipt and/or delivery order that they have no claims regarding the quantity, appearance, and completeness of the goods.
RETURN OF GOODS
6.1. The Buyer has the right to refuse non-excisable goods at any time before their transfer and, after the transfer, in accordance with the procedure and conditions provided by the Law of Ukraine "On Consumer Rights Protection."
6.2. The return of non-excisable goods of proper quality is possible if the commercial appearance, consumer properties, and the document confirming the purchase and conditions of the order are preserved.
6.3. The Buyer does not have the right to refuse custom-made goods of proper quality that have individually defined properties, which can only be used by the Consumer who purchased them (including non-standard sizes and other features at the Buyer's request). The confirmation that the goods have individually defined properties is the difference in size and other characteristics specified in the online store.
6.4. The return of goods, as provided by law and this Agreement, is carried out by contacting the phone number indicated at the bottom of the website.
6.5. In case of the Buyer's refusal of non-excisable goods of proper quality, the Seller refunds the amount equivalent to the value of the goods, excluding the Seller's expenses for returning the goods.
6.6. The refund mentioned in clause 6.5 is carried out simultaneously with the return of the goods.
PARTIES' LIABILITY
7.1. The Seller is not liable for any damage caused to the Buyer as a result of improper use of goods previously ordered on the website https://kartell.store and purchased from the Seller.
7.2. The Seller is not responsible for improper or untimely fulfillment of Orders and obligations if the Buyer provides false or inaccurate information.
7.3. The Seller and the Buyer are responsible for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement.
7.4. The Seller or the Buyer are released from liability for full or partial non-fulfillment of their obligations if it is a result of force majeure circumstances such as war or military actions, earthquake, flood, fire, and other natural disasters that occurred independently of the Seller's and/or the Buyer's will after the conclusion of this agreement. The Party that cannot fulfill its obligations immediately notifies the other Party about it.
